1. Definitions

In these Terms and Conditions:

  • "Service" refers to watch repair, maintenance, and related services provided by Coppergear
  • "Client" or "You" refers to any individual or entity using our services
  • "We", "Us", "Our" refers to Coppergear, operating at 88 Jalan Wong Ah Fook, 80000 Johor Bahru, Johor, Malaysia
  • "Timepiece" or "Watch" refers to any watch or clock submitted for service
  • "Agreement" refers to these Terms and Conditions along with any service-specific terms provided at the time of service

2. Acceptance of Terms

By engaging our services, submitting a timepiece for repair, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

You must be at least 18 years of age to enter into this agreement. If you are under 18, a parent or guardian must consent to these terms on your behalf.

If you do not agree to these terms, please do not use our services.

3. Service Description

Coppergear provides professional watch repair and maintenance services, including but not limited to:

  • Quartz movement replacement
  • Vintage dial rehabilitation
  • Bracelet and clasp servicing
  • General watch maintenance and repair

Services are subject to availability and our assessment of the timepiece's condition. We reserve the right to decline service if we determine the work is beyond our capabilities or if the timepiece cannot be economically repaired.

4. Service Process

4.1 Initial Assessment

Upon receiving your timepiece, we will conduct an initial assessment to determine the required work. We will provide you with an estimate of costs and timeframe before proceeding with any work.

4.2 Authorisation

No work will commence without your explicit authorisation. If additional work is discovered during service, we will contact you for approval before proceeding.

4.3 Timeframes

Estimated completion times are provided in good faith but are not guaranteed. Delays may occur due to parts availability, unforeseen complications, or other factors beyond our control.

4.4 Communication

We will keep you informed of service progress and notify you when your timepiece is ready for collection.

5. Client Responsibilities

As a client, you agree to:

  • Provide accurate information about your timepiece and any known issues
  • Disclose if the timepiece has been previously serviced or modified
  • Collect your timepiece within 30 days of notification that service is complete
  • Pay for services rendered in full upon collection
  • Handle your timepiece with appropriate care before and after service
  • Inform us of any specific requirements or concerns before service begins

6. Payment Terms

6.1 Pricing

All prices are quoted in Malaysian Ringgit (MYR) and include applicable taxes unless otherwise stated. Prices are subject to change, but you will be informed of the final cost before work commences.

6.2 Payment Methods

We accept cash and bank transfer payments. Payment is due in full upon collection of your timepiece.

6.3 Deposits

For services exceeding MYR 1,000, we may require a deposit before commencing work. Deposits are non-refundable if you cancel the service after work has begun.

6.4 Uncollected Timepieces

If a timepiece is not collected within 90 days of completion notification, we reserve the right to charge storage fees of MYR 50 per month. After 180 days, we may dispose of uncollected timepieces in accordance with Malaysian law.

7. Warranty and Service Guarantee

7.1 Service Warranty

We provide a 90-day warranty on labour and replacement parts from the date of service completion. This warranty covers defects in workmanship but does not cover:

  • Damage caused by misuse, accidents, or water exposure beyond the watch's rating
  • Normal wear and tear
  • Issues unrelated to the service performed
  • Cosmetic alterations to vintage pieces performed at client request

7.2 Vintage and Pre-Owned Components

Where vintage or pre-owned components are used (with your prior agreement), these are provided as-is with no warranty beyond our assurance that they were in working condition when installed.

7.3 Warranty Claims

To make a warranty claim, the timepiece must be returned to us within the warranty period. We will assess the issue and repair or replace defective work at no charge if covered by warranty.

8. Limitation of Liability

8.1 Service Provided As-Is

While we exercise professional care and skill, watch repair involves inherent risks, particularly with vintage or damaged timepieces. We cannot guarantee specific outcomes, especially for restoration work.

8.2 Liability Cap

Our total liability for any claim arising from our services is limited to the lesser of:

  • The amount you paid for the specific service in question
  • The value of the timepiece as declared by you at the time of service
  • MYR 5,000

8.3 Excluded Damages

We are not liable for:

  • Sentimental value or subjective losses
  • Consequential or indirect damages
  • Loss of use or opportunity costs
  • Pre-existing damage not disclosed to us

8.4 Insurance

Timepieces are insured while in our care for loss or damage, subject to the limitations above. We recommend maintaining your own insurance for valuable timepieces.

9. Client Property

You retain ownership of your timepiece throughout the service process. By leaving your timepiece with us, you grant us permission to handle, disassemble, and work on it as necessary to complete the requested service.

Removed parts that are replaced during service become our property unless you specifically request their return. Original packaging and documentation will be returned if provided.

We maintain secure storage for timepieces in our care, but you should remove any items of significant value (e.g., expensive straps or modifications) before service if they are not part of the repair scope.

10. Intellectual Property

All content on our website, including text, graphics, logos, and photographs, is the property of Coppergear or its content suppliers and is protected by Malaysian and international copyright laws.

You may view and use our website for personal, non-commercial purposes only. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

11. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and the Personal Data Protection Act 2010 of Malaysia. By using our services, you consent to such processing. Please refer to our Privacy Policy for detailed information.

12. Termination

12.1 Client Termination

You may request to cancel service before work begins. If work has commenced, you will be charged for work completed to date plus any parts ordered.

12.2 Our Right to Refuse Service

We reserve the right to refuse or discontinue service if:

  • You provide false information or documentation
  • The timepiece is suspected to be stolen property
  • You engage in abusive or threatening behaviour
  • Payment is not made as agreed
  • The repair is deemed impossible or unsafe

13. Dispute Resolution

13.1 Governing Law

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Malaysia.

13.2 Informal Resolution

In the event of any dispute or concern, we encourage you to contact us first to resolve the matter informally. Most issues can be resolved through good-faith discussion.

13.3 Legal Action

If informal resolution is unsuccessful, either party may pursue legal remedies through the appropriate Malaysian courts.

14. General Provisions

14.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any service-specific terms, constitute the entire agreement between you and Coppergear regarding our services.

14.2 Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these terms does not constitute a waiver of that provision or our right to enforce it in the future.

14.4 Assignment

You may not transfer or assign your rights or obligations under these terms without our written consent. We may assign our rights and obligations to a successor business.

14.5 Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, government actions, or other force majeure events.

15. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes become effective upon posting to our website. Material changes will be communicated to existing clients via email where contact information is available.

Continued use of our services after changes are posted constitutes acceptance of the modified terms.

We recommend reviewing these terms periodically to stay informed of any updates.
